Is it common for hospitals to make you waive overtime pay the last 4 hrs of a 12 hr shift and only pay overtime after 40 hrs in a week?

If your contract is for twelve hour shifts, then the last 4 are not overtime. If you are signed up to work 40 hours a week, then anything over a cumulative 40 hours would be overtime and must be paid by law.
